Don't talk to the police

Wow, here's 50 minutes very well spent, via Dave's Picks: "Don't Talk to the Police" by Professor James Duane, followed by "Don't Talk to the Police" by Officer George Bruch. Reasons why you shouldn't talk to the police. Period. Whether you're a subject of interest or not.

As a former policeman...

Invoke your right to remain silent.
Insist on legal representation.
If you're not under arrest, leave.
If you are under arrest, see above.

Yep, that's the short version of the above two. They are talks to a class of law students, basically saying "your primary job as a lawyer is to make sure your client invokes their right to remain silent".

The medium version of James Duane's talk is that there's always some law you've broken, whether it's the incident you're being questioned about or not, and the medium version of George Bruch's talk is that that the interrogator interviewer is looking for what that transgression is.

I think the most important issue here is a very important point that the law professor made in the first video. You will never say anything that will help you. If you admit to wrongdoing, it's a confession. If you say anything that will help your case, it's hearsay and the police officer can't repeat it in court. Nothing you ever say will ever help you when being interviewed. ever

The solution? Don't talk, invoke your right to remain silent, insist on an attorney being present, if you're not under arrest, leave and don't say anything at all... even if you're 100% innocent. Whatever you say will never ever ever help you or your friends get out of trouble.

So, I've got to ask, did you get the quiz right?

No, I got the quiz wrong, and I've used that trick before. It's human nature.
