That link backs up something I've been saying for a while: the fourth amendment already protects us against this kind of crap, but the government is breaking the law. We don't need to change the fourth amendment at all, just enforce it.
A while back I took a shot at explaining why we might want to consider changing/upgrading the fifth amendement to deal with digital data. If we start from the assumption NOTHING is private going forward, an expanded right against self-incrimination might be the best way to protect your average person from abuses. (Including abuses from faked data.) And, in the meantime, the government can still get a warrant for suspected criminals and terrorists.
