Speaking from personal experience, the problem probably isn't the lawyers. Most likely it's clueless middle and upper management folks pushing the issue with the legal department. Combine a clueless upper manager with a budding young lawyer and you've got a recipe for law suits. I've always felt that corporate lawyers were probably the worst of the sub-species. I think a little lawyer education is in order too, some refreshers on parody in trademark and copyright law would help keep some of these morons from flying off the handle without a clue on precedent.

What's it going to take to stop this insanity? It's got to be more than just too-many lawyers causing this rash of lawsuits and threatened legal actions.
