Isaac Chotiner interviews Omar Wasow, a professor of politics at Princeton, on how violent protests change politics:

What’s often hard for people to see is that there are these white moderates who are part of the Democratic coalition as long as they perceive there to be order, but when they perceive there to be too much disorder they shift to the party that has owned the issue of order, which is the Republican Party. For some people, the idea that there are these swing Democratic-minded voters is hard to grasp, but there is pretty strong evidence that in 2016, and in 1968, that was an important and influential niche of voters.

You are absolutely right that Trump, to a lot of people, is an instigator of chaos rather than a restorer of order, so I think that potentially works against him. But if you are this white moderate, and perceive the disorder to be coming from African-Americans in cities, then turning to Trump, even if you see him as a rough character, is appealing: He’s a street fighter, but he is our street fighter. So the real danger for advocates of reform in Minneapolis trying to get better policing, and for those trying to pursue racial justice nationally, is that there are people who are turned off by Trump but who have a strong taste for order, and so if they are more concerned about racial disorder, then Trump is their racial order.

The Supreme Court invented qualified immunity in 1967, describing it as a modest exception for public officials who had acted in “good faith” and believed that their conduct was authorized by law. Fifteen years later, in Harlow v. Fitzgerald, the Court drastically expanded the defense. The protection afforded to public officials would no longer turn on whether the official acted in “good faith.” Instead, even officials who violate peoples’ rights maliciously will be immune unless the victim can show that his or her right was “clearly established.” Since the Harlow decision, the Court has made it exceedingly difficult for victims to satisfy this standard. To show that the law is “clearly established,” the Court has said, a victim must point to a previously decided case that involves the same “specific context” and “particular conduct.” Unless the victim can point to a judicial decision that happened to involve the same context and conduct, the officer will be shielded from liability.

He said police departments across the country have been moving away from the neck restraint option for many years because of its "inherent life-threatening potential" and because officers often misinterpret resistance by a suspect, who may simply be struggling to breathe.

History Q: In the late '70s or early '80s, my grandfather, who worked for the New York State Department of Health and as a volunteer firefighter in Floral Park, showed me a handwritten business card that he kept in his wallet next to his license where any police officer asking for identification would see it.

He described this card as a "Mickey Finn" card, and it said something like "Ralph Gode is an upstanding citizen and a friend to all policemen", and was signed by one Mickey Finn.

In his role for the Department of Health he did a lot of law enforcement and fire department training, so if I was out riding around with him in a car and there was something going on he'd inevitably stop and ask, and the response was almost always "Oh, hi, Mr Gode, yeah, you and your grandson step under the ropes and let's show ya what's going on".

(It was situations like those where I was cautioned that you never ever straddle a fire hose, step over quickly.)

I *think* the context in which I saw this card actually used was one of those, where the officer didn't recognize him, he flashed that card, and the attitude completely changed.

I'm assuming the signature came from a Michael Finn somewhere up in the Fraternal Order of Police or the union or something like that.

Anyone got background?

The NYT takes all of the available video of the David McAtee shooting. Turns out what looked like muzzle flash from the restaurant was bottles exploding because of police fired rounds. So, yeah, he was returning fire. Police were shooting at people fleeing into his restaurant. He had no way of knowing that ordinance being shot at him was "non-lethal". The police did not follow department policy in their engagement.

Helping the Protests

My Dad served in US Army Military Intelligence for 6 years. ROTC helped pay for his college, and when his 4 years were over he upped for another 2, and likely would have re-upped again, except that a stint in Vietnam was a surety at that point. Monitoring the Soviets was a cause he could believe in. But he also worked in military/defense adjacent stuff for another couple of years.

Two decades or so later, around 1990, '91, when George Bush was making up reasons to invade Iraq (the first time), he expressed regret, not so much at his military service, but because he did so at a time when the country was exploding in protest, and he'd been solidly inside the establishment, rather than on the streets working to overthrow the horrors and injustices of America of the 1960s.

The other day, someone on Twitter tagged me in a search for mentors of people of color in the software business. And I was like "yeah, I'm happy to help, but I've worked with basically the same small group of people or their friends since coming to California", and then I realized "oh, that's exclusionary as hell and part of the problem, isn't it?"

So as I see the world around me explode (and I've been aware of some of the injustices since my long-haired hippy days), I'm wondering how I can best effect change. Marching in a protest in my town seems twee, a bunch of white people on wide sidewalks in a very white town where the police may be casually racist (I've heard some reports) but know who pays their bills doesn't feel super effective.

Charlene and I watched Selma last night, and talked a little bit about what we might to do help.

I could Sharpie a lawyer's phone number on my wrist and bus down to Oakland or SF, and I'm trying to figure out how I feel about that.

Anyway, we've upped our donations to various organizations that work on these sorts of issues, and bought (take-out) dinner last night from a restaurant that announced that as the mid-way between the park where the Petaluma protests start and the police station, they were happy to provide water and snacks.

PsyArXiv Preprints: Adaptive and Dark Personality in the Covid-19 Pandemic: Predicting Health-behavior Endorsement and the Appeal of Public-health Messages

Who embraces directions to socially distance, boost hygiene, and protect others during a pandemic of contagious respiratory disease? Do differently phrased public-health messages appeal to different people? I based predictions on the five-factor, triarchic psychopathy, and Dark Triad models of normal-range and dark traits; the extended parallel process model (EPPM); and schema-congruence theory. In a survey of 502 online participants, normal-range traits (esp. agreeableness and conscientiousness) predicted endorsement of social distancing and hygiene, as well as the appeal of health messages in general. Consistent with the EPPM, conscientiousness and neuroticism had an interaction. Dark traits (esp. psychopathy, meanness, and disinhibition) predicted low endorsement of health behaviors and the intent to knowingly expose others to risk. Most participants preferred a message appealing to compassion (“Help protect the vulnerable...”), but dark traits predicted lower appeal of that message. Personality appears relevant to epidemiology and public-health communication in a contagious-disease context.

Of course 2020 is seeing my industry move away from terms like "whitelist" and "blacklist" because of the inherent bias those terms carry, and seeing "dark traits" in a psychology paper.

Each time I’ve seen something thrown at police, the majority of the crowd castigates them. When a sideshow turned rowdy with fighting on the periphery, protesters pushed the few troublemakers away while others took over the intersection and knelt, reclaiming their space and refocusing the protest on the issues at hand.

And as for the one case of someone stealing store merchandise on record that I witnessed, through the broken windows of an athletic store in the mall? Police also checked "no" next to the box that says "forced entry" on the form, but witnesses and crime scene photos show officers used a battering ram to force entry into the apartment while Taylor was asleep.

  1. Despite responding “STOP”, I have gotten an unreasonable number of SMS spam messages with the content:



    “Hello, this is [name] with CalETIC4Me. We are reminding people that there still(sic) time to file your taxes online for FREE! You could get CASH back with the Earned Income Tax Credit. More info here: www.caleitc4me.org/ftp”



    The .org rather than .gov domain name, and the copied typo, along with the numerous messages from different senders, make this appear to be a scam message. I had to do some extensive Google searching to convince myself that the site was legitimate.
  2. I am not eligible for this service. Whoever sold you your phone list did extremely bad filtering.

And this is annoying enough that I, and Gen Xer who grew up on BBSes and the Internet, actually dug out paper to send you a physical message begging you to please, as a matter of policy, do better. At best, you're encouraging lower-income people to expect scammy messages to be worth pursuing. At worst, you're annoying a whole lot of voters.

Last August, police officers in Aurora, Colorado, approached 23-year-old Elijah McClain as he walked home from a convenience store. The Aurora Police Department later said that a 911 caller had reported a “suspicious person” in a ski mask, and that when officers confronted McClain — who was not armed and had not committed any kind of crime — he “resisted arrest.” In the 15 minutes that followed, the officers tackled McClain to the ground, put him in a carotid hold, and called first responders, who injected him with ketamine. My Birthday

June 26th: The anniversary of Supreme Court decisions like Obergefell v. Hodges, United States v. Windsor, Lawrence v. Texas. The day after the Lakota, Northern Cheyenne & Arapaho people defeated Custer and his invaders at the Battle of Little Big Horn.

It's also the 52nd anniversary of my birth. Another trip around the an insignificant little star in the outer arm of one of a hundred billion galaxies, and an opportunity for a little navel gazing.

Square dancing, and calling, is on hiatus, and when social touch comes back into style it's pretty clear that whatever we rebuild from that may or may not draw from what we once new as square dancing.

I'm starting to do stuff in the workshop again, which feels super good, projects long on my list are flowing once more.

Work is decent. It's a product I believe in. We transitioned to working from home fairly well.

Aside from the lack of human contact, life is pretty good, personally.

I'm glad to see that the United States is finally taking some action to change the long decline into police state that it's been on. If I had to pick a cause for my birthday, that'd be up there on the list.

So do what you can to build community and justice and empower the people around you, keep making cool things, and we'll put one foot in front of the other and keep walking.

But, please: All the birthday cupcakes that I got yesterday have been delicious (a fantastic chocolate one from Doug, and amazing lemon meringue from Sandy, coffee cake from Phil and Kelly), but I really really need to shed about 20 lbs, so you can hold off on delivering more baked goods.

Sparked by the killing of George Floyd in police custody, the 2020 Black Lives Matter protests have brought a new wave of attention to the issue of inequality within criminal justice. However, many public health officials have warned that mass protests could lead to a reduction in social distancing behavior, spurring a resurgence of COVID-19. This study uses newly collected data on protests in 315 of the largest U.S. cities to estimate the impacts of mass protests on social distancing and COVID-19 case growth. Event-study analyses provide strong evidence that net stay-at-home behavior increased following protest onset, consistent with the hypothesis that non-protesters’ behavior was substantially affected by urban protests. This effect was not fully explained by the imposition of city curfews. Estimated effects were generally larger for persistent protests and those accompanied by media reports of violence. Furthermore, we find no evidence that urban protests reignited COVID-19 case growth during the more than three weeks following protest onset. We conclude that predictions of broad negative public health consequences of Black Lives Matter protests were far too narrowly conceived.

Do bike lanes actually make cyclists safer? — It depends. And design choices have everything to do with it.

The whole premise of bike lanes is that giving cyclists a dedicated space will allow them to ride safely and coexist with vehicle traffic. And yet, bike lanes don’t always make cyclists safer—and sometimes they offer no protections at all. New York City, for example, has reported 34,112 collisions between cyclists and motorists since 2014, despite the addition or enhancement of about 330 miles of bike lanes (with 27 cyclists killed in 2019, the most of any year since 2000).
